Beginning in 2019, several states passed legislation aimed at the use of deepfakes. These laws do not apply exclusively to deepfakes created by AI. Rather, they more broadly apply to deceptive manipulated audio or visual images, created with malice, that falsely depict others without their consent. As previously reported, the NO FAKES Act was introduced in 2024 to create a private right of action addressing the rise of unauthorized deepfakes and digital replicas—especially those misusing... So far in 2025, lawmakers in seven states have passed laws addressing sexually explicit deepfakes, excluding laws that solely address child sexual abuse material. To protect national security against the threats posed by deepfake technology and to provide legal recourse to victims of harmful deepfakes. The new bill will seek to hold social media companies accountable for policing and removing AI generated deepfakepornimages on their sites. The Senate unanimously passed a bill on Tuesday letting victims of nonconsensual intimate images created by AI — or “deepfakes” — sue their creators for damages. “For survivors of this type of abuse, these images cause real harm and can have effects similar to other forms of sexual violence. We thank Senator Durbin for his stewardship of this important legislation and look forward to seeing this bill signed into law.”
